Small Group Plans
Initially, the Affordable Care Act (ACA) defined “small employer” as an employer who employed an average of at least 1 but not more than 100 employees. The Protecting Affordable Coverage for Employees (PACE) Act changed the ACA to allow each state to define a “small employer” as an employer who employed 1-50 or 1-100.
Forty-six states and D.C. have retained the small group 1-50 definition; four states (CA, CO, NY, VT) use the small group 1-100 definition.
Businesses with 51 or more full-time equivalents (both full time and part time employees) are subject to the employer mandate to have to offer health coverage.
