Large Group Plans
Initially, the Affordable Care Act (ACA) defined “large employer” as an employer who employed an average of 101 or more employees. The Protecting Affordable Coverage for Employees (PACE) Act changed the ACA to allow each state to define a “large employer” as an employer who employed 51 or more employees or who employed 101 or more employees.
Forty-six states and D.C. have retained the large group 51 or more definition; four states (CA, CO, NY, VT) use the large group 101 or more definition.
Businesses with 51 or more full-time equivalents (both full time and part time employees) are subject to the employer mandate to have to offer health coverage.
